1. Acceptance of These Terms

By accessing or using our website you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use this site.

You must be 18 years or older to use this site. By continuing, you confirm that you meet this requirement.

2. Australian Consumer Law (ACL) Notice

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Competition & Consumer Act 2010 or any other law that cannot be excluded, restricted or modified by agreement. Where we are permitted to limit our liability for breach of a non‑excludable guarantee, our liability is limited (at our option) to:

replacement of the software; or

the cost of providing replacement software.

We own or license all intellectual‑property rights in the site and its content (including all Image2Punch software). You may view the site in a web browser and print a single copy for your personal reference. You must not otherwise reproduce, distribute, modify, display, publish or create derivative works unless expressly permitted by us in writing.

4. Licence to Use the Website

You may:

view pages in a browser;

download pages for caching;

stream audio or video files we make available; and

use any other functionality expressly offered through a browser interface.

You may use the site only for personal or internal business purposes. You must not:

copy or republish site material;

sell, rent or sub‑license site material;

show site material in public;

exploit site material for commercial gain (other than purchasing a licence key); or

redistribute site material.

We may suspend or restrict access to any part of the site at any time without notice.

5. Acceptable Use

You must not:

use the site in any way that causes or may cause damage or impairs availability or accessibility;

use the site for unlawful, fraudulent or harmful purposes;

transmit viruses, malware or other malicious code;

conduct data scraping, data mining or any automated data‑collection without our prior written consent;

breach the directives in the site’s robots.txt; or

use data obtained from the site for unsolicited direct marketing.

6. Third‑Party Payment Processing

All payments for licence keys are processed by FastSpring (Bright Market LLC). We do not store or process any payment‑card information. Your purchase is subject to FastSpring’s terms of service and privacy policy.

7. Software Licence

Downloading or activating Image2Punch Lite, Image2Punch Genesis or Image2Punch Pro are governed by the End‑User Licence Agreement (EULA) presented during installation or activation. In the event of conflict between these Terms and the EULA, the EULA prevails with respect to the software.

8. Licence Key Conditions

Each licence key issued for Image2Punch Pro or Image2Punch Lite is:

Perpetual – it does not expire;

PC-specific – it is valid only on the computer for which it was originally activated;

Non-transferable – it cannot be reused on another device unless a replacement is granted.

If you change your computer configuration (including hardware upgrades or system reinstalls), the original licence may become invalid. In such cases:

You are entitled to up to 3 free licence key replacements within 2 years of your original purchase, provided you request support via email and can verify your purchase;

Additional replacements beyond this limit may require purchase of a new licence.

We reserve the right to deny replacement requests that appear to be abusive, fraudulent, or outside the stated time and quantity limits.

9. Refund Policy

Because Image2Punch Lite and Image2Punch Pro are delivered digitally, we generally do not offer refunds once a licence key has been issued unless required by the ACL or other applicable law. If you believe the software is faulty, not fit for purpose or mis‑described, please contact support@image2punch.com within 30 days of purchase so we can assist.

10. Disclaimer

We use reasonable efforts to ensure that the information on this site is accurate and current, but we make no representations or warranties, express or implied, about the completeness, accuracy, reliability or availability of the site or its content. The site is provided “as is” and “as available”.

Subject to the ACL, we do not warrant that:

the site will be error‑free or uninterrupted;

the site or the server is free of viruses or other harmful components; or

defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by law and except for any liability under a non‑excludable guarantee, we are not liable for any loss or damage (including indirect or consequential loss, loss of data, loss of profits or business interruption) arising out of or in connection with your use of the site, software or content.

Where liability cannot be excluded but may be limited, our total liability to you is limited to AUD 100 or, if greater, the amount you have paid us for the relevant licence key in the 12 months preceding the claim.

12. Links to Other Sites

The site may contain links to third‑party websites. We provide these links for convenience only and are not responsible for the content or privacy practices of those sites. Access them at your own risk.

13. Termination

We may terminate your access to the site at any time if you breach these Terms. Upon termination, all rights granted to you under these Terms cease immediately.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria and any courts that may hear appeals from those courts.

If any provision of these Terms is held to be invalid or unenforceable, it will be severed and the remaining provisions will remain in force.

15. Changes to These Terms

We may update these Terms from time to time by posting a new version on the site. Significant changes will be notified on the homepage or by email (if we have your address) at least 14 days before they take effect. Continued use of the site after changes take effect constitutes acceptance of the revised Terms.
